- Scope of application
These General Terms and Conditions govern the shipping, logistics intermediation and transport organisation services provided by DR ART LOGISTICS (hereinafter referred to as the “Forwarder”) to the Customer.
DR ART LOGISTICS does not operate as a carrier and does not directly perform the transport of goods, but organises and coordinates shipments by using duly authorised national and international third-party carriers and couriers.
These Conditions apply to all services provided, unless otherwise agreed in writing between the parties.

- Conclusion of the contract
The shipping contract shall be deemed concluded upon acceptance of the offer by the Customer, including through:
• submission of a shipping request;
• written confirmation;
• electronic order;
• completion of online forms.
By concluding the contract, the Customer declares that they have read, understood and fully accepted these General Terms and Conditions.

- Role of the Forwarder
DR ART LOGISTICS acts as a freight forwarder / logistics intermediary, responsible for organising and coordinating the transport of goods on behalf of the Customer.
The physical execution of the transport is entrusted to third-party carriers (including, by way of example and not limitation: FedEx, DHL, SDA, UPS or other authorised carriers), which operate under their own responsibility.

- Customer obligations
The Customer guarantees that:
• the goods are lawful, correctly declared and compliant with applicable regulations;
• the packaging is suitable for the nature of the goods and the requested transport service;
• all information provided (weight, dimensions, value, contents, addresses, documentation) is truthful, complete and accurate.
The Customer shall be liable for any damage, cost, penalty or delay arising from inaccurate, incomplete or non-compliant information.

- Prohibited or restricted goods
It is prohibited to entrust dangerous, illegal or restricted goods for shipment without the prior written authorisation of the Forwarder and without compliance with the applicable regulations (ADR, IATA, IMDG, customs regulations, etc.).
The Forwarder reserves the right to refuse or interrupt the shipment of non-compliant goods.

- Delivery times
Any delivery times provided are purely indicative and shall not constitute an essential term.
DR ART LOGISTICS shall not be liable for delays due to:
• force majeure events;
• customs or administrative inspections;
• adverse weather conditions;
• strikes, blockages, unforeseeable events or causes attributable to third-party carriers.

- Liability for transport
Liability for loss, damage or delay of goods during transport is governed by:
• the general terms and conditions of the appointed carrier;
• applicable national and international conventions (CMR Convention, Montreal Convention, and other sector regulations).
DR ART LOGISTICS shall not be liable as a carrier, but solely as a freight forwarder / intermediary, except in cases of wilful misconduct or gross negligence in the organisation of the service.

- Limitations of liability
The Forwarder shall not be liable for:
• indirect or consequential damages;
• loss of profit or loss of earnings;
• damages resulting from inadequate packaging or the nature of the goods;
• failures attributable to third-party carriers.
Any compensation claims must be addressed to the carrier responsible for the transport.

- Claims
Any claims or disputes must be submitted in writing within the time limits provided by applicable laws and by the conditions of the appointed carrier, including full shipment details.
Failure to comply with such time limits shall result in forfeiture of the right to claim.

- Fees and payments
Fees are those agreed at the time of the order.
In the event of non-payment, DR ART LOGISTICS reserves the right to suspend services and retain documentation and/or goods within the limits permitted by law.

- Personal data processing
The Customer’s personal data are processed in compliance with Regulation (EU) 2016/679 (GDPR) and applicable national legislation.

- Applicable law and jurisdiction
The contract shall be governed by Italian law.
For any dispute, exclusive jurisdiction shall lie with the court of the place where DR ART LOGISTICS has its registered office, unless otherwise mandatorily provided by law.
